    1. BANK OF COMMERCE CASH CARD – The Bank of Commerce Cash Card (“Cash Card”) is issued by Bank of Commerce (“Bank”). Client who purchases the Cash Card shall be referred to herein as “Cardholder”. The Cash Card is a prepaid, reloadable, multi-purpose card where monetary value is stored, represented as Electronic Money (“E-Money”). The E-Money shall not earn interest, rewards or other similar incentives convertible to cash. The Cash Card can be used as a debit card for banking and other lawful transactions but it cannot be purchased at a discount.
    2. CASH CARD PURCHASE – The Cash Card shall be purchased for a fee as prescribed by the Bank.
    3. CASH CARD CREATION AND ACTIVATION – Cash Card will be created upon Cardholder’s submission of accomplished and signed Cash Card Application Form and other required documents. The creation of the Cash Card shall be subject to a processing period determined by the Bank. The Cash Card is active upon delivery to the nominated mailing address of the Cardholder and/or its claim by the Cardholder from the branch where the latter filed the application.
    4. CASH CARD LOADING – The Cash Card can be loaded for a fee as may be prescribed by the Bank, through any of the following: (i) Over-the-Counter (“OTC”) cash load at any Bank of Commerce branch; (ii) fund transfer from an existing CA/SA or Cash Card with the Bank; and (iii) such other manner as may be prescribed by the Bank. The Bank reserves the right to impose and/or change fees for Cash Card loading in such amounts as it may reasonably determine. The rate of such fees, the method of payment and the effectivity of the same shall be disseminated through Bank announcements, which shall be communicated by posting of notices in conspicuous places at the offices or branches of the Bank or in such other form or manner as may be determined by the Bank. The fees shall be binding against and payable by the Cardholder if the Cash Card is used after the Bank’s announcement. An aggregate monthly load limit (AMLL) of one hundred thousand pesos (PhP 100,000.00) shall be observed under one customer, unless a higher limit shall be announced by the bank. In case a reload transaction exceeds the declared AMLL, transaction shall be rejected. Loading of Cash Cards shall be further subject to applicable rules and regulations which may be imposed by the Bangko Sentral ng Pilipinas (BSP).
    5. CASH CARD USAGE – The Cash Card may be used to (i) purchase items, goods or services at accredited merchants; (ii) withdraw cash through designated automated teller machines (“ATM”); (iii) receive or transfer E-Money from or to another Cash Card; (iv) inquire the balance of stored E-Money; (v) change Cash Card Personal Identification Number (“PIN”) for ATM; (vi) reload E-Money; (vii) pay bills; and (viii) such other uses as may be allowed by the Bank.
    6. INTERNATIONAL ACCESS – All Cash Card purchase and/or withdrawal transactions in other currencies made outside of the Philippines, shall be converted into its Philippine Peso equivalent. All conversions shall be based on the prevailing exchange rate of the Bank at the time of the transaction which shall be deemed as valid and binding upon the Cardholder. Applicable foreign exchange mark-up rate is also applied to cover service fee and assessment fees charged by Mastercard. Transaction fee/s charged by the concerned merchants and ATM owner abroad computed based on prevailing exchange rate of the Bank at the time of the transaction, shall also be applicable. Such withdrawal/payment constitutes a disbursement from the Cash Card in the Philippines and a remittance to the country where the withdrawal / payment transaction was effected, and shall, therefore be subject to the applicable laws, government rules and regulations of both the Philippines and the country where the withdrawal/ payment transaction is made.
    1. REFUND OR CASH OUT OF THE CASH CARD BALANCE – The Cardholder is allowed to request for a refund/cash out of the card load value for his/her card at any time, subject to payment of applicable fees and charges of the Bank which will be deducted from the requested refund/cash out load amount. The refund/cash out load amount can only be issued via (i) Manager’s Check or (ii) crediting to BankCom Deposit Account under the name of the Cardholder within 7 banking days from the date of request.
    2. OTHER CASH CARD SERVICES – The Cardholder may request for a copy of the transaction history of the Cash Card loading and usage and/or request for a new PIN Mailer for fees as may be prescribed by the Bank.
    3. AUTHENTICATION PROCESS – The Cardholder agrees to comply with the following authentication procedures:

    9.1. For ATM transactions – insert the Cash Card in the ATM card slot and enter Cash Card PIN for ATM.9.2. For POS transactions – swipe or insert the Cash Card on the POS terminal and enter Cash Card PIN for ATM and/or sign transaction slip 9.3. For Online transactions – Input the 16-digit card number indicated on the front portion of the Cash Card and the Card Verification Value (CVV) that can be found at the back portion that is composed of 3 digits and beside the signature panel 9.4.

    SECURITY OF THE CASH CARD – The care and security of the Cash Card is the sole responsibility of the Cardholder. The Cardholder hereby agrees to safeguard the Cash Card as if it were cash. The Cardholder agrees to observe the guidelines stated below, and comply with the relevant safety and security requirements for the use of the Cash Card.

    10.1. Internet Banking 10.1.1. Securing Login ID, Password or PIN and Other Login credentials 10.1.1.1. Cardholder should not disclose to any person the Login ID, Password or PIN and other login credentials on the computer.10.1.1.2. Cardholder should not store Login ID and Password or PIN and other login credentials on the computer.10.1.1.3.

    • Cardholder should regularly change password or PIN and other login credentials, and avoid using easy-to-guess passwords such as names or birthdays.10.1.1.4.
    • Cardholder should keep personal information private.
    • He should not disclose personal information such as address, mother’s maiden name, telephone number, social security number, bank account number or e-mail address unless the one collecting the information is reliable and trustworthy.10.1.2.

    Observing internet security measures 10.1.2.1. Cardholder should check for the right and secure website of the Bank ( https://www.bankcom.com.ph). Cardholder should ensure that the website is “secure” by checking the Universal Resource Locators (URLs) which should begin with “https” and a closed padlock icon on the status bar in the browser is displayed.10.1.2.2 Before doing any online transactions or sending personal information, Cardholder should make sure that the correct website has been accessed.

    • He should beware of bogus or “look alike” websites that are designed to deceive consumers.10.1.2.3 To confirm authenticity of the site, Cardholder should double-click on the lock icon to display security information of the site.10.1.2.4.
    • Cardholder should not send any personal information particularly password or PIN via ordinary e-mail.10.1.2.5.

    Cardholder should not open other browser windows while banking online.10.1.2.6. Cardholder should avoid using shared or public personal computers and public internet or WiFi in conducting internet banking transactions.10.1.2.7. Cardholder should disable the “file and printer sharing” feature on the operating system if conducting internet banking transactions.10.1.2.8.

    1. Cardholder should contact the Bank to discuss security concerns and remedies to any online e-banking account issues.10.2.
    2. Automated Teller Machine (ATM) 10.2.1 Cardholder should use ATMs that are familiar or that are in well-lit locations where one feels comfortable.
    3. If the machine is poorly lit or is in a hidden area, Cardholder should look for another ATM.

    Cardholder should have the Cash Card ready before approaching the ATM, and avoid having to go through the wallet or purse to find the card. Cardholder should not use ATMs that appear to have been tampered with or otherwise altered, and report such condition to the bank which owns the ATM.10.2.2.

    Cardholder should memorize ATM PIN and never disclose it to anyone. He should not keep the PIN or passwords in the wallet or purse, or write them on the Cash Card. He should avoid using easily available personal information as passwords, like birthdays, nicknames, mother’s maiden names or consecutive numbers.10.2.3.

    Cardholder should shield the keypad with hand when keying in the PIN and be mindful of persons who attempt to view the PIN and transaction details.10.2.4. If the ATM is not working correctly, Cardholder should cancel the transaction and use a different ATM.

    1. If possible, he should report the problem to the bank which owns the ATM.10.2.5.
    2. Cardholder should carefully secure the Cash Card and cash in the wallet, handbag, or pocket before leaving the ATM.
    3. He should not let other people use the Cash Card.
    4. If the Cash Card is stolen, report the incident immediately to Bank of Commerce Call Center using contact numbers provided by the Bank.10.3.

    Other Electronic Channels 10.3.1. Cardholder should not disclose access or login credentials to anyone and ensure regular updating.10.3.2. If the electronic account has been compromised, Cardholder should report the incident immediately to the bank or institution operating the electronic channel involved.

    INACTIVE CASH CARD – A Cash Card shall automatically be placed in inactive status after a period of three hundred sixty (360) days of inactivity from the date of last Cash Card transaction. A Cash Card, while in inactive status, shall be subject to a monthly maintenance fee as prescribed by the Bank, to be automatically deducted from the outstanding stored value of the Cash Card on the month following the start of its inactive status. Once the stored value of the inactive Cash Card becomes zero, the Cash Card will be automatically tagged as closed;

    1. ACCREDITED MERCHANTS – Mastercard accredited merchants worldwide and BancNet merchants will accept or honor Cash Cards as mode of payment for purchases of goods and services at regular selling price for cash customers, without extra percentage or charge for the use of the Cash Card.
    2. AUTHORIZED SALES OUTLETS – The Cash Card may be purchased only from the Bank and its branches.
    3. LOST OR STOLEN CARD – Lost or stolen Cash Card shall be immediately reported by the Cardholder to Bank of Commerce Customer Care Hotline. Cardholder shall also submit duly accomplished Declaration of Loss form, present valid ID, and other requirements as may be prescribed by the Bank. All transactions generated by the use of the lost or stolen Cash Card shall be deemed conclusively binding upon the Cardholder, and the Bank will not be liable for any loss or damage incurred by the Cardholder prior to reporting of the loss of card. Upon compliance with the requirements of the Bank, and provided that the lost or stolen Cash Card is not expired at the time it was reported lost or stolen, a new Cash Card will be issued to the Cardholder and any outstanding stored balance of the lost or stolen Cash Card may be transferred to the new Cash Card, after deducting any and all fees due to the Bank.
    4. DAMAGED OR DEFECTIVE CASH CARD – The Bank shall replace damaged Cash Card (if previously used) or defective Cash Card (if never been used), subject to the surrender of the Cash Card, and provided that the same is not expired at the time of surrender. The Bank shall issue a replacement Cash Card with stored value equal to the remaining balance of the damaged or defective Cash Card, after deducting any and all fees due to the Bank. Replacement of a damaged Cash Card shall be subject to replacement cost charged to Cardholder, while replacement of defective Cash Card shall be at no cost to Cardholder.
    5. AMENDMENT – The Bank reserves the right to amend the terms and conditions herein, and any such amendment shall be binding upon the Cardholder upon notice at least thirty (30) calendar days before any amendment/changes to the terms and conditions may take effect, by posting of said amendments in conspicuous places at the offices or branches of the Bank, or by publication or other means of communication, electronic or otherwise.
    6. UNDERTAKING – In case of over credit, erroneous credit or misposting of any amount to the Cardholder’s Cash Card as appearing in the records or books of the Bank, and for whatever cause, including but not limited to systems error or error in communication facilities, the Cardholder hereby agrees that the Bank has the absolute authority to deduct from the stored balance of the subject Cash Card, the excess or erroneous credit or misposted amount without need of notice or demand, or any further act or deed, and without the Bank or its representatives incurring any liability as a consequence thereof. The Cardholder likewise gives absolute authority to the Bank to deduct from the outstanding stored balance of the Cash Card any and all expenses, costs and damages which the Bank may have incurred in view of the over credit, erroneous credit or misposting of amount that is not due to the Bank’s fault or negligence. This is without prejudice to the exercise by the Bank of its right to enforce full recovery and collection of the excess or erroneous credit or misposted amount in case the Cardholder’s Cash Card cannot be debited for any reason such as but not limited to insufficient balance, as well as to the exercise by the Bank of other legal remedies to which it may be entitled under the law and this Agreement, including but not limited to the immediate cancellation or suspension of the Cash Card. Pending full recovery or collection by the Bank of the excess or erroneous credit or misposted amount, the Cardholder is considered to be holding the said amount in trust for the Bank, and failure or refusal of the Cardholder to account for and return the excess or erroneous credit or misposted amount to the Bank shall give rise to a prima facie presumption of misappropriation or conversion with intent to defraud on the part of the Cardholder.
    7. LIMITATION OF LIABILITY – The Cardholder agrees that the Bank’s liability for any loss or damage that the Cardholder may incur from the issuance or use of the Cash Card, which is attributable to the fault or gross negligence of the Bank, shall in no case exceed the amount of Php10,000.00 or the actual damage, whichever is lower. Any claim or complaint relative to any Cash Card transaction under the provision of this paragraph, must be presented within ten (10) calendar days from the date of such transaction, otherwise, it shall be deemed irrevocably waived. This provision shall survive the termination or suspension of the right to use the Cash Card.
    8. NON-LIABILITY – The Bank shall not be liable for any loss or damage of whatever nature in connection with transactions involving the Cardholder’s use of the Cash Card, in any of the following instances: (i) disruption, failure or delay relating to or in connection with Cash Card transactions due to circumstances beyond the control of the Bank or fortuitous events such as, but not limited to prolonged power outages, breakdown in computers and communication facilities, typhoons, floods, public disturbances and calamities and other similar or related cases; (ii) fraudulent or unauthorized utilization of Cash Card due to theft or unauthorized disclosure of PIN/Username/Password or violation of other security measures with or without the Cardholder’s participation and/or arising out of authorized or unauthorized use of the Cash Card, including card skimming (i.e. illegal copying of information from the magnetic strip of a credit or debit card, like the Cash Card) and/or use of skimmed Cash Card; (iii) inaccurate, incomplete or delayed information received due to disruption or failure of any communication facilities used for the Cash Card (iv) mechanical defect in or malfunction of the electronic device on which the Cash Card is used (i.e. ATM POS or other channels), failure and/or malfunction of any mechanical, electronic or other part, component system or network upon which the ATM or branch computer is critically dependent for normal and efficient operations; (v) non-crediting of any amount to the Cash Card due to over-crediting as prescribed by any law, government rule or regulation; and/or (vi) improper or unauthorized use of the Cash Card’s facilities and electronic devices (i.e. ATM, POS, etc); or recklessness or accident in connection with the use thereof. Further, the Bank shall not be liable for any indirect, incidental or consequential loss, loss of profit or damage that the Cardholder may suffer or has suffered by reason of the use or failure or inability to use the Cash Card under the terms and conditions herein. This provision shall survive the termination or suspension of the rights to use the Cash Card.
    9. AGREEMENT TO TERMS AND CONDITIONS – This Agreement shall be subject to existing policies and procedures of the Bank relative to Cash Cards which are deemed incorporated herein by way of reference, and as may be amended or supplemented by the Bank from time to time as it may deem necessary. The Cardholder hereby agrees that his/her signature on the Enrollment Form and/or use of Cash Card, constitutes the Cardholder’s agreement to these terms and conditions as well as the acceptance of the corresponding risks associated with the use of the Cash Card.
    10. COMPLIANCE WITH EXISTING LAW/S – The Cardholder hereby warrants that his use of the Cash Card, specifically, the transfer and/or receipt of funds through the use of the Cash Card, does not and will not violate the applicable provisions of the Anti-Money Laundering Law or its amendments, and other pertinent laws, government rules or regulations. The Cardholder hereby renders the Bank free and harmless from any liability whatsoever which may arise from the Cardholder’s violation of said laws or government rules or regulations.
    11. DISCLOSURE OF INFORMATION – The Cardholder expressly agrees to the disclosure by the Bank or its related company, as it deems fit, of any and all information about the Cardholder or his Cash Card transactions to other companies, financial institutions, any third party, and/or any government regulatory agency, without the Bank or its related company, incurring liability as a consequence thereof.
    12. DATA PRIVACY LAW – The Cardholder hereby authorize and give his consent to the Bank, its employees, affiliates, subsidiaries, authorized representatives and/or accredited third party partners to collect, verify, store, share, and process his/her personal and/or sensitive information as required by Data Privacy Act of 2012 (R.A.10173) at Implementing Rules and Regulations and other applicable laws and regulations. In this regard, the Cardholder hereby hold the Bank, its officers, employees, affiliates, subsidiaries, authorized representatives, accredited third party partners, agents, assignees, and successors-in-interest, free and harmless from any and all claims, actions, suits, damages, liabilities, costs and expenses that may arise directly or indirectly from the disclosure, collection, verification, storing, sharing and processing of any and all information and credit data.
    13. NO PDIC COVERAGE – The Bank of Commerce Cash Card or the value stored therein is not a deposit, and is not insured by the Philippine Deposit Insurance Company (PDIC).
    14. JURISDICTION – The Cardholder (a) consents that any suit, legal action or proceeding arising from or in connection with the terms and conditions herein or any document issued in connection herewith shall be brought in Philippine courts, or any courts in any jurisdiction in which the Cardholder and/or any of his properties or assets is or may be found or located; (b) consents that any suit, legal action or proceeding to execute or otherwise to enforce any judgment rendered in any action filed in connection with the terms and conditions herein or any document issued in relation herewith shall be brought in Philippine courts, or any courts in any jurisdiction in which the Cardholder and/or any of his properties or assets is or may be found or located; (c) waives any objection to the laying of the venue of any suit, action or proceeding brought in an inconvenient forum; and (d) agrees that final judgment in any such suit, action or proceeding brought in such court shall be conclusive and binding upon him and may be enforced in Philippine courts or any courts in any jurisdiction in which Cardholder or his assets may be found, at the option of the Bank.
    15. ATTORNEY’S FEE AND VENUE – Venue of all suits directly or indirectly arising from the relationship between the Bank and the Cardholder shall be governed by the Rules on Venue under the Rules of Court.
    16. GOVERNING LAW –The terms and conditions herein shall be governed by and construed in accordance with Philippine laws.
    17. CARDHOLDER COMPLAINTS – Any complaint regarding the Cash Card or its use, or both, shall be communicated immediately to Bank of Commerce Customer Care Hotline at contact numbers provided by the Bank. If the Bank deems it necessary, the Bank will conduct an investigation on the complaint for its prompt resolution and communicates its findings to the Cardholder. The Cardholder agrees to fully cooperate with any such investigation by providing necessary or required data, information, and documents.
    18. FREEZING OF FUNDS, DEACTIVATION OF A CASH CARD AND/OR TERMINATION OF RELATIONSHIP- The Bank reserves the right to freeze the funds stored in the Cash Card, deactivate the Cash Card and/or terminate whatever relationship it has with the Cardholder at any time without prior notice, under any of the following circumstances: (i) breach of any of the terms and conditions relevant to the issuance and use of the Cash Card; (ii) the Bank receives a report or information that the Cash Card has been used or is being used in criminal or illegal acts; (iii) knowledge of death, bankruptcy or lack of legal capacity of the Cardholder; (iv) the Bank receives an order from a court of competent jurisdiction or a duly constituted tribunal to freeze the funds of the Cardholder and (v) other reasonable grounds that the Bank has determined to be sufficient to freeze the funds in the Cash Card, deactivate the Cash Card and/or terminate the relationship with the Cardholder. Any liability that the Cardholder has incurred shall survive such termination.
    19. AUTHORITY TO SET OFF – The Bank reserves the right to exercise set-off against the available balance on the Cash Card owned by the Cardholder, without any prior notice or demand, in the event of any outstanding debts, obligations, or liabilities owed by the Cardholder to the Bank, whether arising from the use of the Cash Card or any other contractual relationship between the Bank and the Cardholder. To facilitate this transfer, the Cardholder consents, authorizes, appoints, and irrevocably designates the Bank or its duly authorized representative as the ATTORNEY-IN-FACT, with full power and authority to investigate, assert liens or legal claims, set off or apply any of the available balance held by the Bank for the payment of any of the said outstanding debt, obligation or liability. The set-off or application of payment shall not relieve the Cardholder from paying any deficiency
    20. SUBJECT TO GRANISHMENT – The available balance of the Cash Card held by the Bank is subject to garnishment to satisfy any legal orders, judgments, or claims against the Cardholder. The Bank may, in accordance with applicable laws and regulations, comply with garnishment orders issued by authorized legal authorities and deduct or freeze the necessary funds from the Cash Card balance to fulfill such obligations.
    21. CONSENT, AUTHORIZATION AND INDEMNIFICATION – By using the Cash Card or entering into any agreement with the Bank, the Cardholder expressly consents and authorizes the Bank to exercise its right of set-off, compliance to valid garnishment orders, freezing of funds, deactivation of a Cash Card and/or termination of relationship with the Cardholder as described in this legal statement. The Cardholder acknowledges and agrees that such actions are necessary and reasonable for the protection of the Bank’s interests and compliance with legal obligations. The Cardholder shall indemnify and hold the Bank free and harmless from any claims, losses, damages, injuries, costs, or expenses which may arise, directly or indirectly, from the freezing of funds, deactivation of a Cash Card and/or termination of relationship with the Cardholder, or the Bank’s exercise of its right to set-off or compliance to garnishment orders. This includes but is not limited to any legal fees or expenses arising from defending against claims related to the set-off, garnishment, freezing, deactivation or termination of relationship actions.
    22. BSP CIRCULAR NO.649 and BSP CIRCULAR 1166. To the extent applicable, these terms and conditions shall be subject to BSP Circular No.649 series of 2009 which provides the guidelines governing the issuance of E-money and the operations of electronic money issuers (EMI) in the Philippines and BSP Circular 1166 series of 2023: Amendments to the Regulations E-money and the operations of EMl in the Philippines and any amendment thereof, which is deemed incorporated herein by reference.

    1. BANK OF COMMERCE CASH CARD – Ang Bank of Commerce Cash Card (“Cash Card”) ay isang prepaid (babayaran/kakargahan muna ng pera bago magamit), reloadable (maaring kargahan/hulugan kapag naubos na ang laman para patuloy na magamit), at multi-purpose (maraming mapaggagamitan; halimbawa: bilang isang debit card sa mga transakyon sa bangko at iba pang mga legal na transakyon; tingnan din ang panglimang talata) na card (tarheta) na pinagkaloob ng Bank of Commerce (“Bangko”) sa sinumang bibili nito (“Cardholder”). Ang halaga ng perang ikakarga (ilo-load) sa Cash Card ay siya ring katumbas ng magiging laman ng Cash Card na tinatawag na Electronic Money (“E-Money”); halimbawa: 1 Peso = 1 Peso (E-money). Ang E-money ay hindi tutubo ng kahit anu mang interes, puntos o iba pang katulad na mga insentibo na maaaring ipalit bilang salapi (cash).
    2. PAGBILI NG CASH CARD – Ang pisikal na Cash Card ay kailangang bilhing hiwalay sa karga (load) nito, sa presyong itinakda ng Bangko.
    3. PAGGAWA, PAGPO-PROSESO AT PAGPAPAGANA NG CASH CARD – Ang Cash Card ay gagawin at ipo-proseso ng Bangko pagkatapos na maipasa ng aplikante ng Cash Card ang kanyang Cash Card Application Form na may kumpletong sagot at lagda, kalakip ang iba pang mga itinakdang dokumento. Ang paggawa at pagproseso ng Cash Card ay mangangailangan ng karampatang panahon na tutukuyin ng Bangko. Ang Cash card ay maari nang gamitin (active) ng Cardholder sa oras na kanyang matanggap ito sa pamamagitan ng pagpapadala ng Bangko sa isinulat na tirahan o pahatirang-sulat (address) ng aplikante ng Cash Card (Cardholder) o kaya naman kapag ito ay kinuha ng Cardholder mula sa branch kung saan niya ipinasa ang kanyang aplikasyon.
    4. PAGKARGA (PAG- LOAD ) NG CASH CARD – Ang pagpapalagay ng laman, pagpapakarga o pag- load ng Cash Card ay may karampatang bayad (fee) sa halagang itatakda ng Bangko at hiwalay sa halaga ng mismong ipapakarga o ipapa- load ng Cardholder sa kanyang Cash Card. Ang pagpapakarga o paglo- load ng Cash Card ay maaaring gawin sa pamamagitan ng alin man sa mga sumusunod: (i) Over-the-Counter (“OTC) o may paghalili ng cash teller sa saan mang branch ng Bangko; (ii) paglipat ng pondo mula sa isang Current/Savings Account (CA/SA) o mula sa anumang Cash Card ng inisyu ng Bangko; at (iii) iba pang paraan na itatakda ng Bangko. Ang Bangko ay may karapatang magpataw at/o magbago ng presyo ng bayad (fee) para sa pagpaparkaga at pagpapa- load ng Cash Card. Ang rate ng bayad (fee) para sa pagpapakarga at pagpapa- load ng Cash Card, ang paraan ng pagbabayad at simula ng pagpapatupad ng nasabing bagong panuntunan ay mabibigyang bisa lamang pagkatapos ng maipakalat o mai-anunsyo ng Bangko sa pamamagitan ng pag-paskil ng mga abiso at paunawa sa mga kapansin-pansing lugar sa mga tanggapan o branch ng Bangko o iba pang pamamaraan ng itatakda ng Bangko. Ang nasabing bagong rate ay sasaklaw at magiging pananagutan ng Cardholder kung kanyang gagamitin ang Cash Card pagkatapos ng ginawang anunsyo ng Bangko. Ang kabuuan o pinakasagad na halagang maaring ikarga o i- load ng isang Cardhodler sa kanyang Cash Card sa loob ng isang buwan ay P100,000.00 (Aggregate Monthly Load Limit) maliban kung ito ay itataas ng Bangko. Hindi mapo-proseso ang anumang pagpapakarga o paglo- load kung lumagpas na o lalagpas ang Cardhodler sa nasabing hangganang (limit) itinakda para sa isang buwan. Ang pagpapakarga o paglo- load ng Cash Card ay napapasailalim din sa mga patakaran at regulasyon na inilabas at maaaring ilabas ng Bangko Sentral ng Pilipinas (BSP) kaugnay dito.
    5. PAGGAMIT NG CASH CARD – Ang Cash Card ay maaaring magamit sa (i) pagbili ng mga produkto o serbisyo mula sa mga awtorisadong tindahan; (ii) pag- withdraw ng pera (cash) mula sa mga itinalagang automated teller machine (“ATM”); (iii) pagtanggap o paglipat ng E-money mula sa o patungo sa isa pang Cash Card; (iv) pag-alam ng balanse o laman ng E-Money; (v) pagpalit ng Personal Identification Number (“PIN”) ng Cash Card para sa ATM; (vi) pag-karga o pag- load ng E-Money; (vii) pagbayad ng mga bills; at (viii) iba pang mga gamit na maaaring pinahintulutan ng Bangko.
    6. PAGGAMIT NG CASH CARD SA IBANG BANSA – Lahat ng mga transaksyon sa pagbili at/o pag- withdraw gamit ang Cash Card sa ibang mga salapi bukod sa Philippine Peso na ginawa sa labas ng Pilipinas ay kukunin ang katumbas nito sa Philippine Peso. Ang halaga ng palitan ay batay sa kasalukuyang palitan ng Bangko sa oras ng transaksyon na itinuturing na wasto at obligadong bayaran ng Cardholder. Ang kaukulang rate ng mark-up sa palitan ng salapi ay ipinapataw din upang masaklaw ang bayad sa serbisyo at mga assessment fee na ipinapataw ng Mastercard. Ang bayad sa transaksyon na kinokolekta ng mga awtorisadong tindahan at may-ari ng ATM sa ibang bansa ay pinagbabatayan din ng kasalukuyang palitan ng Bangko sa oras ng transaksyon, kaya’t may bisa rin ito. Ang ganitong withdrawal o bayad ay nagpapahayag ng pagbawas mula sa balanse ng Cash Card sa Pilipinas at pagpapadala ng kaukulang halaga sa bansa kung saan isinagawa ang withdrawal o kabayaran na transaksyon, at ito ay sakop ng mga naaangkop na batas, mga patakaran, at regulasyon ng gobyerno sa Pilipinas at sa bansa kung saan isinagawa ang withdrawal o bayad na transaksyon.
    1. PAGBABALIK NG BALANSE NG CASH CARD – Pinapahintulutan ang Cardholder na humiling ng pagbabalik ng kaukulang halaga o pera mula sa kanyang Cash Card sa anumang oras, sakop ang pagbabayad ng mga naaangkop na bayarin at singil ng Bangko na ibabawas mula sa halaga o perang ibabalik sa Cardholder mula sa kanyang Cash Card. Ang kaukulang halaga o perang ibabalik Cardholder ay maaari lamang ibigay sa pamamagitan ng (i) Manager’s Check o (ii) sa pag-deposito sa BankCom Deposit Account na nakapangalan sa Cardholder sa loob ng pitong araw ng negosyo mula sa petsa ng hiling ng pagbalik ng kaukulang halaga o pera mula sa kanyang Cash Card.
    2. MGA IBA PANG SERBISYONG NG CASH CARD – Ang Cardholder ay maaaring humingi ng kopya ng kasaysayan ng kanyang transaksyon ng pag- load at paggamit ng Cash Card at/o humiling ng bagong PIN Mailer. Subalit ang serbisyong ito ay kailangang bayaran ng Cardholder sa halagang itatakda ng Bangko.
    3. PROSESO NG PAGPAPATUNAY – Ang Cardholder ay sumasang-ayon sa mga sumunod na pamamaraan ng pagpapatunay:

    9.1 Para sa mga transaksyon sa ATM – ipasok ang Cash Card sa card slot ng ATM at pindutin o i- type ang iyong Cash Card PIN.9.2 Para sa mga transaksyon sa Point-of-Sale (“POS”) – i- swipe o ipasok o itapik ang Cash Card sa terminal ng POS at i- type ang iyong Cash Card PIN para sa ATM at/o pumirma sa transaction slip.9.3 Para sa mga transaksyon Online – ilagay ang iyong Card Number na binubuo ng labing-anim na numerong makikita sa harapang bahagi ng Cash Card at iyong Card Verification Value (CVV) na makikita naman sa likurang bahagi ng Cash Card na binubuo ng tatlong numero at katabi ng iyong lagda.9.4 Para sa mga transaksyon sa Internet Banking – i-rehistro sa internet banking ang iyong Cash Card Number (na binubuo ng labing-anim na numerong makikita sa harapang bahagi ng Cash Card) upang magamit ito bilang pambayad sa mga bills o sa paglipat ng pondo.

    SEGURIDAD NG CASH CARD – Ang Cardholder ay ang nag-iisang may responsibilidad sa pangangalaga at seguridad ng Cash Card. Dahil dito, sumasang-ayon ang Cardholder na kanyang pangangalagaan ang Cash Card na para itong hawak na salapi (cash). Sumasang-ayon ang Cardholder na susundin ang mga patnubay na nakasaad sa ibaba, at susunod sa mga kaukulang panuntunan sa kaligtasan at seguridad para sa paggamit ng Cash Card.

    10.1. Internet Banking 10.1.1. Pagsisiguro sa Login ID, Password o PIN at iba pang mga kailangang impormasyon sa pag-Login 10.1.1.1. Hindi dapat ipaalam ng Cardholder sa ibang tao ang kanyang Login ID, Password o PIN at iba pang mga kailangang impormasyon sa pag-Login sa computer.10.1.1.2.

    1. Hindi dapat iwanan o i- save sa computer ng Cardholder ang kanyang Login ID, Password o PIN at iba pang mga kailangang impormasyon sa pag-Login.10.1.1.3.
    2. Dapat madalas na palitan ng Cardholder ang Password o PIN at iba pang mga impormasyon sa pag-Login, at iwasan ang paggamit ng mga Password na madaling mahulaan tulad ng pangalan o petsa ng kaarawan.10.1.1.4.

    Dapat panatilihing pribado ng Cardholder ang kanyang mga personal na impormasyon. Huwag dapat ibunyag ang mga personal na impormasyon gaya ng tirahan (address), pangalan ng ina noong ito ay dalaga pa (mother’s maiden name), numero ng telepono (telephone number), numero ng Social Security (SSS Number), numero ng bank account o e-mail address, maliban kung ang pagsasabihan o ang nangongolekta ng impormasyon ay maaasahan at mapagkakatiwalaan.10.1.2.

    1. Pagpapanatili ng seguridad sa internet 10.1.2.1.
    2. Dapat siguraduhin ng Cardholder na tama ang napuntahang website ng Bangko ( https://www.bankcom.com.ph).
    3. Dapat tiyakin ng Cardholder na ang website na kanyang napuntahan ay ligtas (secure) sa pamamagitan ng paghanap sa status bar sa browser ng Universal Resource Locators (URLs) na dapat nagsisimula sa “https” at mayroong imahe ng nakasaradong kandado (padlock).10.1.2.2.

    Bago gumawa ng anumang mga online na transaksyon o maglagay o magpadala ng personal na impormasyon online, dapat tiyakin ng Cardholder na tama ang website na kanyang napuntahan o na- access, Dapat siyang mag-ingat at maging mapanuri sa mga peke o bogus o “kamukhang” website na sadyang dinisenyo upang linlangin ang mga tao.10.1.2.3.

    Para makumpirma kung and isang site ay lehitimo, pindutin o i- click ng dalawang beses (double-click) ang imahe ng kandado (padlock) upang makita ang impormasyon tungkol sa seguridad ng site.10.1.2.4. Huwag magpapadala ng anumang personal na imporamasyon lalo na ang Password o PIN sa pamamagitan ng ordinaryong e-mail.10.1.2.5.

    Hindi dapat magbukas ang Cardholder ng ibang mga window ng browser habang nagbabangko online 10.1.2.6. Dapat iwasan ng Cardholder ang paggamit ng computer na hindi niya pagmamay-ari o maging mga pampublikong computer at internet o Wfi sa pagsasagawa ng mga transaksyon sa internet banking.10.1.2.7.

    1. Huwag munang paganahin ang “file and printer sharing” sa operating system kung magsagawa ng mga transaksyon sa internet banking.10.1.2.8.
    2. Aagad na makipag-ugnayan sa Bangko tungkol sa seguridad, remedyo o solusyon para sa anumang katanungan, isyu o problema sa online e-banking account.10.2.
    3. Automated Teller Machine (ATM) 10.2.1.

    Dapat gamitin ng cardholder ang mga ATM na pamilyar na sa kanya o kaya naman ang mga nakapwesto sa maliliwanag na lokasyon kung saan mayroong kapanatagan gamitin ito. Kung ang ATM ay nasa madilim o nasa isang nakatagong lugar, dapat ay maghanap na lamang ang Cardholder ng iba pang ATM.

    Dapat ay ihanda ng Cardholder ang kanyang Cash Card bago pa man siya lumapit sa ATM at iwasan ang paghahanap nito sa pitaka (wallet) o bag kung kalian kaharap na ang ATM. Hindi dapat gamitin ng Cardholder ang mga ATM na mukhang kahina-hinalang ginalaw o kaya naman ay mayroong kakaiba at kaagad na ipagbigay alam ang naging obserbasyon sa bangkong nagmamay-ari ng kahina-hinalang ATM.10.2.2.

    Dapat kabisahin (memorize) ng Cardholder ang ATM PIN ng kanyang Cash Card at huwag kailanman ito ibabahagi o ipaaalam kaninuman. Huwag magtatago sa pitaka (wallet) o bag ng anumang naglalaman ng PIN o Password. Huwag ring isusulat and mga ito sa saan mang bahagi ng Cash Card.

    • Dapat iwasan sa pagtatalaga ng Password ang paggamit ng madaling malaman na personal na impormasyon tulad ng petsa ng kaarawan (birthday), palayaw (nickname), pangalan ng ina noong ito ay dalaga pa (mother’s maiden name) o kaya naman magkakasunod na mga numero.10.2.3.
    • Dapat takpan ng Cardholder gamit ang isang kamay ang keypad ng ATM habang pinipindot ng kabila niyang kamay ang PIN sa Cash Card.

    Maging maingat at mapagmatyag sa mga taong nagtatangkang silipin o alamin ang iyong PIN o kaya naman ang detalye ng iyong transaksyon.10.2.4. Kung ang ATM ay hindi gumagana nang tama, dapat na kanselahin ng Cardholder ang transaksyon at gumamit ng ibang ATM.

    Kung maaari, dapat niyang iulat ang problema sa bangko na nagmamay-ari ng ATM.10.2.5. Dapat ingatan ng Cardholder ang Cash Card at salapi (cash) sa kanyang pitaka (wallet), bag, o bulsa bago umalis sa ATM. Hindi niya dapat ipagamit sa ibang tao ang kanyang Cash Card. Kung sakaling manakaw naman ang Cash Card, kaagad ng ipagbigay alam sa Bank of Commerce Customer Care Hotline ang insidente gamit ang mga numero na binigay ng Bangko.10.3.

    Iba pang mga Electronic Channels 10.3.1. Hindi dapat ipaalam ng Cardholder ang mga kredensyal o impormasyon sa pag-access o pag- login sa sinuman at tiyakin ang regular na pagpalit nito.10.3.2. Kung ang electronic account ay nakumpromiso, kaagad na ipag-bigay alam ng Cardholder ang pangyayari sa Bangko o institusyon na nagpapatakbo ng electronic channel na nasangkot.

    1. HINDI AKTIBONG CASH CARD – Ang isang Cash Card ay magiging hindi aktibo (inactive) pagkatapos ng 360 araw nang hindi aktibong paggamit nito mula sa petsa ng huling transaksyon ng Cash Card. Ang isang Cash Card habang ito ay hindi aktibo ay sisingilin ng buwanang maintenance fee sa halagang itinakda ng Bangko na ibabawas naman mula sa natirang balanse ng Cash Card na magsisimula sa susunod na buwan mula sa araw na ang Cash Card ay naging hindi aktibo. Kapag wala nang natitirang balanse (zero balance) ang Cash Card na hindi aktibo ay kusang magsasara (close) at hindi na magagamit.
    2. MGA KINIKILALANG/PINAGKAKATIWALAANG (ACCREDITED) TINDAHAN – Ang tindahan na kinikilala o pinagkakatiwalaan (accredited) ng Mastecard sa buong mundo at maging BancNet ay tumatanggap ng Cash Card bilang paraan ng pagbabayad para sa mga nabiling produkto at serbisyo sa regular na halaga o katulad lamang ng presyong ibinibigay sa mga mamimili (customer) na nagbabayad gamit ay salapi (cash). Sumakatwid, walang anumang dagdag na porsyento o singil para sa paggamit ng Cash Card sa nasabing nabili.
    3. MGA LEHITIMONG (AUTHORIZED) BILIHAN NG CASH CARD – Ang Cash Card ay mabibili lamang mula sa Bangko at mga branch nito.
    4. NAWALA O NINAKAW NA CARD – Kailangan ireport kaagad ng Cardholder sa Bank of Commerce Customer Care Hotline, Ang Cardholder ay dapat ding magpasa ng Declaration of Loss form na naglalaman ng kumpletong sagot, magpakita ng lehitimong tarheta ng pagkakakilanlan (identification Card/ID), at iba pang rekisito (requirements) na maaaring hingin ng Bangko. Ang lahat ng mga transaksyong pumasok o papasok gamit ang nawala o ninakaw na Cash Card ay itinuturing na pananagutan ng Cardholder, at ang Bangko ay walang pananagutan sa anumang kawalan o pinsalang natamo ng Cardholder bago maipagbigay alam ang pagkawala ng Cash Card. Matapos ipasa ang mga rekisito ng Bangko at sa kondisyong hindi pa paso (expired) ang Cash Card sa oras ng pagbibigay alam ng pagkawala o pagkanakaw nito, isang bagong Cash card ang ibibigay sa Cardholder at ang anumang natitirang balanse ng nawala o nanakaw na Cash Card ay maaaring malipat sa bagong Cash Card, pagkatapos ibawas ang anuman at lahat ng mga bayarin (fees) para sa Bangko.
    5. NASIRA O DEPEKTIBONG CASH CARD – Papalitan ng Bangko ang nasirang Cash Card (kung dati nang nagamit) o may depektong Cash Card (kung hindi pa ito nagagamit), basta ibabalik ng Cardholder ang nasira o depektibong Cash Card sa Bangko at dapat ay hindi pa ito paso (expired) sa oras ng pagbalik. Ang Bangko ay mag-iisyu ng isang kapalit na Cash Card na naglalaman ng halaga katumbas ng natitirang balanse sa nasira o depektibong Cash Card, pagkatapos mabawas ang anuman at lahat ng mga bayarin (fees) na ukol para sa Bangko. Ang Cardholder ay may babayarang replacement fee sa Bangko para sa pagpapalit nito ng nasirang Cash Card. Samantala wala naming kailangan bayaraan ang Cardholder para sa pagpapalit ng depektibong Cash Card.
    6. PAGBABAGO O PAG-AMIYENDA (AMENDMENT) – Ang Bangko ay may karapatan na baguhin o amiyendahan ang mga tuntunin at kondisyon na nakasaad dito, at ang mga nasabing amiyenda ay sasaklaw at nagbibigay pananagutan sa Cardhodler kapag siya ay naabisuhan nang hindi bababa sa tatlumpung (30) araw sa ilalim ng kalendaryo (calendar days) bago magkabisa ang anumang pagbabago sa mga tuntunin at kondisyon, sa pamamagitan ng paglalagay ng mga nabanggit na amiyenda sa mga kapansin-pansing lugar sa mga opisina o branch o Bangko, o sa pamamagitan ng paglalathala o iba pang paraan ng komunikasyon, elektroniko o iba pa.
    7. PANGAKO (UNDERTAKING) – Kapag may sobra (over credit), mali (erroneous credit) o maling paglalagay (misposting) ng anumang halaga sa Cash Card ng Cardholder na lumitaw sa mga talaan o mga libro ng Bangko, sa anumang dahilan, tulad ng, at hindi limitado sa, pagkakamli o error sa sistema o sa mga pasilidad ng komunikasyon, ang Cardholder ay sumasang-ayon na ang Bangko ay may ganap at lehitimong awtoridad na ibawas mula sa nilalamang balanse ng nasabing Cash Card ang naging sobra o maling credit o maling nailagay (misposted) na halaga nang hindi nangangailangan ng abiso o paghingi, o anumang karagdagang pagkilos o gawa, ng walang anumang pananagutan sa parte ng Bangko o mga kinatawan nito. Ang Cardholder ay nagbibigay din ng ganap at lehitimong awtoridad sa Bangko ng ibawas mula sa sa natitirang balanse ng Cash Card ang anumang gastos at pinsala na maaring natamo ng Bangko nang dahil sa sobrang credit, maling credit o maling paglalagay (misposting) ng halaga sa Cash Card na hindi dulot ng pagkakamali o kapabayaan ng Bangko. Sa kabila ng mga nabanggit, ang Bangko ay hindi mawawalan ng karapatang ipatupad ang buong pagbawi at pagkokolekta ng sobra o maling credit o maling nailagay na halaga kung sakaling ang Cash Card ay hindi maaaring bawasan sa anumang kadahilanan tulad ng, at hindi limitado sa, hindi sapat na balanse, gayundin sa paggamit ng Bangko ng iba pang mga legal ng remedyo na naaayon sa batas at sa Kasunduang ito, kabilang na ang agarang pagkansela o pagsuspinde ng Cash Card. Habang nakabinbin ang buong pagbawi o pagkolekta ng Bangko ng sobra o maling naibayad na halaga, ang Cardholder ay itinuturing na hinahawakan lamang ang nasabing halaga para sa Bangko, at ang kabiguan o pagtanggi ng Cardholder na ibalik sa Bangko ang sobra o maling credit o maling nailagay (misposted) na halaga sa Cash Card ay maituturing na isang prima facie presumption o paniniwala ng paglustay (misappropriation) o pag-angkin (conversion) na may intensyon na mandaya o manloko sa bahagi ng Cardholder.
    8. LIMITASYON NG PANANAGUTAN – Sumasang-ayon ang Cardholder na ang pananagutan ng Bangko para sa anumang pagkawala o matatamo niyang pinsala kaugnay sa pagbibigay at pagtanggap (issuance) o paggamit ng Cash Card, na dulot ng kasalanan o kapabayaan ng Bangko, ay hindi lalagpas sa halagang P10,000.00 o sa halaga ng aktwal na pinsalang natamo, alinman ang mas mababa. Ang anumang paghahabol (claim) o reklamo na may kaugnayan sa anumang transaksyon sa Cash Card sa ilalim ng probisyong ito, ay dapat ihain ng Cardholder sa Bangko sa loob ng sampung (10) araw sa ilalim ng kelendaryo (calendar days) mula sa petsa ng naturang transaksyon, at ang hindi paghain sa loob ng itinakdang panahon ay ituturing na boluntaryong pagsuko ng karapatan at kailanman ay hindi na ito mababawi (irrevocable waiver). Ang probisyong ito ay mananatiling epektibo sa kabila ng pagwawakas o suspensyon ng karapatang gamitin ang Cash Card.
    9. WALANG PANANAGUTAN – Ang Bangko ay hindi mananagot para sa anumang pagkawala o pinsalang matatamo na may kaugnayan sa mga transaksyong mula sa paggamit ng Cardholder ng Cash Card, sa alinman sa mga sumusunod na pagkakataon: (i) pagkagambala, pagkabigo o pagkaantala na may kaugnayan sa mga transaksyon sa Cash Card dulot ng mga pangyayari na wala sa kontrol ng Bangko o kaya naman ay mga hindi inaasahang pangyayari (fortuitous events) tulad ng, ngunit hindi limitado sa, mga matagal na pagkawala ng kuryente, pagkasira sa mga computer at mga pasilidad ng komunikasyon, bagyo, baha, mga kaguluhan at kalamidad sa kapaligiran at iba pang katulad o kaugnay na mga pangyayari; (ii) mapanlinlang o hindi awtorisadong paggamit ng Cash Card dahil sa pagnanakaw o hindi awtorisadong pagsisiwalat ng PIN/Username/Password o paglabag sa iba pang mga hakbang sa seguridadng Cash Card, mayroon man o walang partisipasyon o kinalaman ang Cardholder at/o dahil sa awtorisadong o hindi awtorisadong paggamit ng Cash Card, kabilang ang card skimming (halimbawa: ilegal na pagkopya ng impormasyon mula sa magnetic strip ng isang Cash Card) at/o paggamit ng na-skim na Cash Card; (iii) mali o hindi wasto, hindi kumpleto o naantalang pagtanggap ng impormasyon dahil sa pagkagambala o pagkasira ng anumang mga pasilidad ng komunikasyon na ginagamit para sa Cash Card (iv) mekanikal na depekto o hindi wastong paggana ng elektronikong aparato kung saan ginagamit ang Cash Card (halimbawa: ATM, POS, o iba pang mga channels), pagkasira at/o hindi paggana ng anumang mekanikal, elektroniko o iba pang bahagi ng sistema o network kung saan ang ATM o branch computer ay nakasalalay para sa normal at mahusay nitong operasyon; (v) hindi pagpasok (pag- credit ) ng anumang halaga sa Cash Card dahil sa sobrang credit alinsunod sa anumang batas, tuntunin o regulasyon ng pamahalaan; at/o (vi) mali o hindi wasto o hindi awtorisadong paggamit ng mga pasilidad at elektronikong aparato ng Cash Card (halimbawa: ATM, POS, at iba pa) ; o kapabayaan o aksidente na may kaugnayan sa paggamit nito. Bukod sa mga nabanggit, ang Bangko ay hindi mananagot para sa anumang di-tuwiran, hindi sinasadya o kinahinatnan na pagkawala o pagkalugi, pagkawala ng kita o pinsala na maaaring maranasan o naranasan ng Cardholder dahil sa paggamit o pagkabigo o kawalan ng kakayahan na gamitin ang Cash Card sa ilalim ng mga tuntunin at kundisyon dito. Ang probisyong ito ay mananatiling epektibo sa kabila ng pagwawakas o suspensyon ng karapatang gamitin ang Cash Card.
    10. PAGTANGGAP SA MGA TUNTUNIN AT KONDISYON – Ang Kasunduang ito ay sakop ng mga kasalukuyang patakaran at pamamaraan ng Bangko na may kaugnayan sa Cash Card na itinuturing na parte rin ng Kasunduang ito at maaring gamiting batayan (reference), at maaaring amiyendahan, baguhin o dagdagan ng Bangko kapag kinakailangan. Sumasang-ayon ang Cardholder na ang kanyang lagda o pirma sa Enrollment Form at/o paggamit ng Cash Card, ay magpapahiwatig ng pagsang-ayon ng Cardholder sa mga tuntunin at kondisyon ng Kasunduang ito pati na rin ang pagtanggap ng mga kaukulang panganib na kaugnay sa paggamit ng Cash Card.
    11. PAGSUNOD SA MAG KASALUKUYANG BATAS – Tapat na ipinapangako ng Cardholder na ang paggamit niya ng Cash Card, partikular na ang paglipat at/o pagtanggap ng mga pondo sa pamamagitan ng paggamit ng Cash Card, ay hindi lumalabag at hindi lalabag sa naaangkop na mga probisyon ng Anti-Money Laundering Law o mga amiyenda nito, at iba pang may kinalaman na mga batas, mga panuntunan o regulasyon ng pamahalaan. Malayang ipinapahayag at ipinapangako ng Cardholder na ang Bangko ay kailanman mapapawalang sala at hindi isasama or makakasama sa anumang pananagutan na dulot ng paglabag ng Cardholder sa mga nasabing batas o mga patakaran o regulasyon ng pamahalaan.
    12. PAGLALAHAD NG IMPORMASYON – Ang Cardholder ay sumasang-ayon sa pagpapahayag o pagsasabi ng Bangko o ng mga kaanib na kumpanya nito, sa paniniwala na ito ay naangkop, ng anuman at lahat ng impormasyon tungkol sa mga transaksyon ng Cardholder o ng kanyang Cash Card sa ibang mga kumpanya, mga institusyong pinansyal, anumang ikatlong partido, at/o anumang ahensiya ng regulasyon ng gobyerno, nang walang pananagutan sa bahagi ng Bangko o kaanib na kumpanya nito.
    13. DATA PRIVACY LAW – Binibigyan ng Cardholder ang Bangko at ang empleyado o lehitimong kinatawan (affiliates, subsidiaries, authorized representatives and/or accredited third party partners) nito ng pahintulot (consent) at karapatan na kolektahin, kumpirmahin, itago, ibahagi o iproseso ang kanyang personal at/o sensitibong impormasyon na nalalahad at nasasaklaw sa ilalim ng Data Privacy Act of 2012 (R.A.10173) at implementing Rules and Regulations nito at iba pang mga kaakibat at kaugnay na batas. Dahil ditto, ipinangangako at sinisigurado ng Cardholder na ang Bangko at mga opisyal, empleyado o lehitimong kinatawan (affiliates, subsidiaries, authorized representatives and/or accredited third party partners, agents) at mga sinalinan ng karapatan nito ay mapapawalang sala at hindi kailanman mananagot sa anumang kasong isasampa kaugnay sa o pinsala na maaaring maging resulta ng mga nabanggit na pagsabi, pagkuha, pagkumpirma, pagtago, pagbahagi o pagproseso ng impormasyon at maging credit data ng Cardholder.
    14. HINDI SAKOP NG PDIC – Ang Bank of Commerce Cash Card o ang lamang balanse nito ay hindi isang deposito, at hindi sakop ng Philippine Deposit Insurance Company (PDIC).
    15. HURISDIKSYON – Ang Cardholder (a) ay sumasang-ayon at pinahihintulutan na ang anumang kaso, legal na aksyon o paglilitis na nagmula sa o may kaugnayan sa mga tuntunin at kondisyon ng Kasunduang ito o anumang dokumentong ibinigay kaugnay dito ay dapat na ihain sa alin mang korteng matatagpuan sa Pilipinas, o anumang korte sa anumang hurisdiksyon kung saan ang Cardholder at/o anuman sa kanyang mga ari-arian o mga ari-arian ay o maaaring matagpuan o matatagpuan; (b) ay sumasang-ayon at pinahihintulutan din na ang anumang kaso, legal na aksyon o paglilitis upang maipatupad o kung hindi man ay ipatupad ang anumang kautusan o desisyon na igawad sa anumang kaso na isinampa kaugnay ng mga tuntunin at kondisyon sa Kasunduang ito o anumang dokumentong inilabas kaugnay dito na inihain o idulog sa alin mang korte sa Pilipinas, o anumang korte sa anumang hurisdiksyon kung saan ang Cardholder at/o anuman sa kanyang mga ari-arian ay maaaring matagpuan o matatagpuan; (c) ay kanyang isinusuko at hindi tututulan ang pagsasampa ng anumang kaso, aksyon o paglilitis sa hindi kaaya-ayang bahay-hukuman (inconvenient forum); at (d) ay sumasang-ayon na ang huling desisyon sa anumang naturang kaso, aksyon o paglilitis na dinala sa naturang hukuman ay ang magwawakas ng sigalot, mayroong bisa sa kanya, at maaaring ipatupad sa anumang mga korte sa Pilipinas, o anumang mga korte sa anumang hurisdiksyon kung saan maaring matagpuan ang Cardholder o ang kanyang mga ari-arian, sa opsyon ng Bangko.
    16. ATTORNEY’S FEES AT LUGAR NG PAGHAHAINAN NG KASO (VENUE) – Ang Rules on Venue sa ilalim ng Rules of Court ang magiging batayan o basehan para malaman ang lugar kung saan maaaring ihain ang kaso na may kaugnayan sa relasyon sa pagitan ng Bangko at ng Cardholder.
    17. BATAS NA MAMAHALA O MAGIGING BASEHAN (GOVERNING LAW) – Ang mga tuntunin at kondisyon dito ay pinamamahalaan at binibigyang kahulugan alinsunod sa mga batas ng Pilipinas.
    18. MGA REKLAMO NG CARDHOLDER – Ang anumang reklamo tungkol sa Cash Card o paggamit nito ay dapat agad na iparating sa Bank of Commerce Customer Care Hotline sa mga numerong ibinigay ng Bangko. Kung sa pananaw ng Bangko ay kinakailangan, ito ay magsasagawa ng pagsisiyasat sa reklamo para sa mabilisang resolusyon nito at ang anumang resulta ay ipaaalam sa Cardholder. Ang Cardholder ay sumasang-ayon na makikipagtulungan sa anumang naturang pagsisiyasat sa pamamagitan ng pagbibigay ng kinakailangang datos, impormasyon, at mga dokumento.
    19. PAG- FREEZE NG PONDO/BALANSE, PAG- DEACTIVATE NG CASH CARD AT/O PAGPUTOL NG RELASYON – Ang Bangko ay may karapatang i- freeze ang nilalamang balanse ng Cash Card, i- deactivate ang Cash Card at/o putulin ang anumang relasyon nito sa Cardholder sa anumang oras nang walang paunang abiso, sa ilalim ng anuman sa mga sumusunod na pagkakataon: (i) paglabag sa alinman sa mga tuntunin at kondisyon na may kaugnayan sa pagbibigay/pagtanggap (issuance) at paggamit ng Cash Card; (ii) ang Bangko ay nakatanggap ng sumbong o impormasyon na ginamit o ginagamit ang Cash Card sa mga kriminal o iligal na gawain; (iii) impormasyon tungkol sa pagkamatay, pagkalugi o kakulangan ng legal na kapasidad ng Cardholder; (iv) ang Bangko ay nakatanggap ng utos mula sa korte na may karampatang hurisdiksyon o mula sa itinalagang hukuman o ahensya upang i- freeze ang balanse ng Cardholder at (v) iba pang mga katanggap-tanggap at makatwirang dahilan na maituturing ng Bangko na sapat upang i- freeze ang balanse sa Cash Card, i- deactivate ang Cash Card at/o putulin ang relasyon sa Cardholder. Ang anumang pananagutan ng Cardholder sa ilalim ng Kasunduang ito ay mananatili at maaring habulin ng Bangko sa kabila ng nasabing pagputol o pagtapos ng relasyon.
    20. KARAPATAN SA PAGSASAGAWA NG SET-OFF – Ang Bangko ay may karapatan na magpatupad ng off-setting laban sa balanse na nasa Cash Card na pag-aari ng Cardholder, nang walang anumang paunang abiso o paghahabol, sa pangyayari ng anumang mga utang, obligasyon, o pananagutan na utang ng Cardholder sa Bangko, mula sa paggamit ng Cash Card o anumang ibang kontraktwal na relasyon sa pagitan ng Bangko at Cardholder. Upang mapadali ang paglilipat na ito, ang Cardholder ay sumasang-ayon, nagbibigay ng pahintulot, nagtatalaga, at itinatalaga ang Bangko, pagtatalagang hindi kailanmang babawiin ng Cardholder, bilang kanyang awtorisadong kinatawan (ATTORNEY-IN-FACT), na may ganap na kapangyarihan at otoridad upang imbestigahan, magpatunay ng liens o legal na mga demanda or paghahabol, magpatupad ng set-off o gamitin ang anumang naiwang balanse na hawak ng Bangko para sa pagbabayad ng anumang nabanggit na mga utang, obligasyon, o pananagutan. Ang set-off o pag-apruba ng pagbabayad ay hindi magpapalaya sa Cardholder sa pagbabayad ng anumang kulang.
    21. NASASAILALIM SA GARNISHMENT – Ang balanse ng Cash Card na hawak ng Bangko ay maaaring masailalim sa garnishment upang matugunan ang anumang legal na mga utos, hatol, o mga paghahabol laban sa Cardholder. Ang Bangko ay maaaring, alinsunod sa mga naaangkop na batas at regulasyon, sumunod sa mga utos ng garnishment na inilabas ng mga legal na awtoridad at bawasan o i-freeze ang kinakailangang pondo mula sa balanse ng Cash Card upang tuparin ang mga obligasyong gaya nito.
    22. PAGPAPAYAG, PAGPAPAHINTULOT AT PAGBABAYAD-PINSALA – Sa pamamagitan ng paggamit ng Cash Card o pagpasok sa anumang kasunduan sa Bangko, malinaw na sumasang-ayon at nagbibigay ng pahintulot ang Cardholder sa Bangko na gamitin ang karapatan nitong magpatupad ng set-off, sumunod sa garnishment order, mag-freeze ng mga pondo, i-deactivate ang Cash Card, at/o putulin ang ugnayan sa Cardholder ayon sa inilalarawang legal na pahayag na ito. Kinikilala at pinapayagan ng Cardholder na ang mga hakbang na ito ay kinakailangan at makatuwiran para sa proteksyon ng interes ng Bangko at pagsunod sa mga legal na obligasyon. Ang Cardholder ay nangangakong magbabayad ng danyos at itataguyod ang kalayaan ng Bangko mula sa anumang mga paghahabol, pagkalugi, pinsala, gastos, o gastusin na maaaring magresulta, direkta o hindi direktang, mula sa pag-freeze ng mga pondo, pag-deactivate ng Cash Card at/o pagputol ng ugnayan sa Cardholder, o sa paggamit ng Bangko ng karapatan nitong magpatupad ng set-off o sumunod sa mga utos ng garnishment. Kasama rito ngunit hindi limitado sa anumang mga bayarin o gastos sa abogado na maaaring magresulta mula sa pagtatanggol sa mga paghahabol kaugnay ng mga hakbang na set-off, garnishment, pag-freeze, pag-deactivate, o pagputol ng ugnayan.
    23. BSP CIRCULAR NO.649. Hangga’t naaangkop (applicable), ang mga tuntunin at kondisyon na ito ay nasasakop ng BSP Circular No.649 serye ng 2009 na naglalatag ng mga alituntunin sa pamamahala ng E-money at mga operasyon ng EMI sa Pilipinas at BSP Circular 1166 series of 2023: Amendments to the Regulations E-money and the operations of EMl in the Philippines at anumang amiyenda nito, na itinuturing nakapaloob dito o parte ng Kasunduang ito bilang basehan (reference).
